E-Car-Rent - Car Rental Marketplace in Kosovo

1. General Terms

By accessing and using E-Car-Rent ("the Platform"), you accept and agree to be bound by these Terms of Service. The Platform connects vehicle owners ("Hosts") with renters ("Renters") for peer-to-peer car rental services in Kosovo. If you do not agree to these terms, please do not use our services.

2. User Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, current, and complete information during registration. Email and phone verification may be required. You agree to notify us immediately of any unauthorized use of your account.

3. Booking & Cancellation

Bookings can be made through instant booking or request-based approval. All bookings are subject to Host approval unless marked as "Instant Booking". Cancellation policies vary by listing and are displayed before booking. Platform fees are non-refundable. Renters may cancel up to 24 hours before the trip start time for a full refund (excluding service fees), unless otherwise specified. Hosts may cancel bookings but may be subject to penalties for repeated cancellations.

4. Payment Terms

All payments are processed through our secure payment gateway (LemonSqueezy). A platform fee (typically 10-15% of the rental price) is charged to Renters at the time of booking and paid online. The remaining rental amount is paid directly to the Host in cash at vehicle pickup. Security deposits may be required and are held separately. Refunds for cancelled bookings are processed within 5-7 business days.

5. Host Responsibilities

Hosts must provide accurate vehicle information and photos. All vehicles must have valid registration and insurance. Hosts are responsible for vehicle maintenance and cleanliness. Hosts must respond to booking requests within 24 hours. Hosts must provide clear pickup/return instructions. Hosts are responsible for verifying renter documentation (driver's license, ID). Hosts must accurately represent vehicle condition and features.

6. Renter Responsibilities

Renters must possess a valid driver's license for the duration of the rental. Renters are responsible for the vehicle during the rental period. Renters must return the vehicle on time and in the same condition. Renters must follow all traffic laws and regulations. Renters are responsible for any traffic violations, tolls, or parking fees incurred during the rental. Renters must not sublease the vehicle to third parties. Smoking, pets, and off-road use may be prohibited unless explicitly allowed by the Host.

7. Liability & Insurance

All vehicles must have valid third-party liability insurance provided by the Host. Basic insurance coverage is included in the rental price. Additional coverage options may be available. Renters are responsible for damages not covered by insurance up to the security deposit amount. E-Car-Rent is a platform connecting Hosts and Renters and is not responsible for vehicle condition, accidents, or disputes between parties. Renters and Hosts agree to resolve disputes directly or through our mediation services.

8. Dispute Resolution

In case of disputes between Hosts and Renters, both parties agree to first attempt resolution through E-Car-Rent's customer support. If resolution cannot be achieved, parties may pursue mediation or legal action in accordance with Kosovo law. E-Car-Rent reserves the right to suspend or terminate accounts involved in fraudulent activity or repeated violations of these terms.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy. We collect and process personal data in accordance with GDPR and Kosovo data protection regulations. We do not share your personal information with third parties except as necessary to provide our services or as required by law.

10. Modifications to Terms

E-Car-Rent reserves the right to modify these Terms of Service at any time. Users will be notified of significant changes via email or platform notifications. Continued use of the Platform after changes constitutes acceptance of the modified terms. If you do not agree to the changes, you must discontinue use of the Platform.
